4. Terms & conditions

All design and rendering fees are non-refundable.

  1. Non-Refundable Payment: The design fee is non-refundable. Payment of this fee secures the Company's time and resources dedicated to creating a custom plan. The work invested in this design is specific to the Client's property and cannot be repurposed. Under no circumstances will the design fee be returned or refunded once paid.
  2. Payment Terms: Design fee must be paid prior to beginning work.
  3. Forms of Payment Accepted: Preferred forms of payment are ACH transfer, Zelle or Check. All debit and credit cards used will be charged a 3.5% processing fee.
  4. Application of Fee to Future Project: If the Client chooses to move forward and contract John Franklin Landscapes, LLC for the full installation of the designed project, the entire design fee will be credited and applied toward the final invoice for that project.
  5. Discontinuation of Services: If the Client decides not to proceed with the landscape installation project after the design is completed, the design fee will be retained in full by the Company as payment for the design services rendered. No refund will be issued.
  6. Disputed Transactions: Once the renderings have been completed and delivered to the Client, any transactions that are disputed or result in a chargeback will incur additional fees. The Client agrees to cover all associated bank fees, administrative costs, and legal expenses arising from such disputes or chargebacks. John Franklin Landscapes, LLC reserves the right to take legal action to resolve any unresolved transactions, and all costs associated with such actions will be the responsibility of the Client.
  7. Design Delivery: The Company will deliver the completed design rendering to the Client within 7 to 10 business days after the design fee payment has been received in full and has fully cleared our financial institution.
  8. Additional Fees: Additional design work and hours exceeding the hours specified will be charged an additional $250 per hour.
  9. Ownership and Marketing Rights: The Client acknowledges that John Franklin Landscapes, LLC retains ownership of all rights to the design created under this Custom Design Agreement. The Client grants John Franklin Landscapes, LLC permission to use the design, including photographs and project details, for marketing, portfolio, and promotional purposes. This includes, but is not limited to, use on the company's website, social media platforms, and printed materials.
